Administrative procedures for wind power plants construction are simplified

The investment prospects of renewable energy plants construction Act № 2517-VIII came into effect on 4 October 2018. The Act simplifies the administrative procedures for wind powerplants construction.

According to the Act a wind power plant may be classified as an object with minor environmental impact (SS1) if every other condition of the Act is fulfilled. A compulsory assessment for such projects is needed only to evaluate the environmental impact according to the Environment Impact Assessment Act.

Oleh Kostiuchenko, Head of Power engineering and natural resources practice of Sokolovskyi and Partners Law Firm believes these changes will improve fund-raising for wind farm projects. The Investment prospects of renewable energy plants construction Act makes it possible to start a construction with a Notice to Proceed which should be sent to the relevant building supervisory authority. And a permission to operate can be received after sending a Statement of operational readiness of a wind power plant. These simplification dramatically reduce the level of potential corruption, to almost zero.

It is worth noting, however that this Act has no impact on the whole renewable energy industry. In other words, it does not simplify the administrative procedures of solar power plants construction.
